1.0 Acceptance of terms

Your access to and use of sportingexcellencegroup.co.uk and associated aliases (“the Website”), is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

2.0 Advice

The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making any decision.

3.0 Changes to website

Sporting Excellence Group Limited (“SEG”) reserves the right to:

5.1 All copyright, trademarks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to SEG or otherwise used by SEG as permitted by law.

5.2 In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

6.0 Disclaimers and limitation of liability

6.1 The Website is provided on an “AS IS” and “AS AVAILABLE” basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

6.2 To the extent permitted by law, SEG will not be liable for any indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.

6.3 SEG makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

6.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of SEG for death or personal injury as a result of the negligence of SEG or that of its directors, officers, employees or agents.

7.0 Indemnity

You agree to indemnify and hold SEG and its directors, officers, employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against SEG arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

8.0 Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

9.0 Governing law

These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.

Terms of Conditions for Coaching Clinics and Other Courses

YOUR ATTENTION IS PARTICULARLY DRAWN TO THE PROVISIONS OF PARAGRAPH 5 (COVID 19) AND PARAGRAPH 6 (LIABILITY).

1. Booking

Upon booking a coaching clinic through our website or otherwise, you are agreeing to these Terms and Conditions. SEG will, following their acceptance of a correctly completed registration form (if applicable) and its receipt of the appropriate payment, send a confirmatory email confirming the booking. SEG reserves the right to refuse entry to any coaching clinic if it has not received an appropriately completed registration form or full payment of the appropriate fees.

2. Data Protection

When registering for a coaching clinic you will be asked to provide your some contact details, including a contact mobile telephone number and email address. SEG is committed to protecting your personal information.

We will only use your personal information as set out in our Privacy Policy.

3. Refunds

For SEG 10 week block coaching sessions the refund policy is as follows:

There will be no refunds once SEG has confirmed, by email, an athlete’s place on any 10 week block of sessions.

For the holiday camps the refund policy is as follows:

  • 21 days or more prior to the start of the camp – Full Refund

  • 10 to 20 days prior to the start of the camp – 60% Refund

  • 6 to 9 days prior to the start of the camp – 40% Refund

  • 5 days or less prior to the start of or during the camp – NO Refund

4. Admission

Participation in any SEG coaching clinic is at the participants own risk. By attending any coaching clinic you consent to those in your group participating in the activities.

5. COVID-19

In light of the current COVID-19 pandemic, by accepting these Terms and Conditions, you understand that there are particular risks associated with attending any outdoor gathering (including our coaching clinics). We will take all reasonable steps to comply with any relevant guidelines intended to reduce the spread of COVID-19 and we will make you aware of these measures. However, we cannot be responsible for the behaviour or health of other participants at our coaching clinics and cannot effectively ensure that no participants will have COVID-19. Accordingly, we will not be responsible if you catch COVID-19 at any of SEG’s coaching clinics and accordingly, participation at any SEG coaching clinic is at the participants own risk.

You understand and accept that you will be attending any SEG coaching clinic and using any facilities at your own risk.

To help us to reduce the spread of COVID-19, we ask that you:

  • To help us to reduce the spread of COVID-19, we ask that you:
  • do not attend any coaching clinic if*:
  • you have tested positive for COVID-19 within 10 days of any coaching session;
  • you are waiting for a COVID-19 test result
  • you display any symptoms of COVID-19;
  • you have been contacted under the NHS Track and Trace system and told to self-isolate; or
  • you are otherwise required to self-isolate.

*note that where there is a conflict between any of the provisions in this paragraph and any updated government guidelines, the updated government guidelines will apply;

  • follow all government guidelines (which may be updated from time to time);
  • notify us immediately if you test positive for COVID 19

6. Liability

SEG will not be held liable for any loss, injuries or damages sustained at any coaching clinics including damage, theft or losses to property and motor vehicles, if the cause is due to the negligence of the participant or anybody associated with such participant or the unforeseeable actions of other patrons or third parties.

By accepting these terms and conditions you agree to release and hold harmless SEG for any liability whatsoever for any damage or injury, personal or mental, which you might incur as a result of your voluntary decision to attend SEG’s coaching clinics.

SEG does not accept any responsibility for injury as a result of ground conditions.

SEG does not exclude any liability for death or personal injury caused by our negligence or where such limitation or exclusion is not permitted by law.

7. General

Use of Images

SEG may take pictures and videos of participants in coaching sessions for use on SEG’s website, Facebook, Instagram or twitter pages or for marketing material. If any participant or any parent of any participant does not want their image to be used in this way please inform SEG in writing at info@sportingexcellencegroup.co.uk at the time of registration for any coaching clinic.

Lost Property

SEG does not accept responsibility for any lost or stolen items.

Conduct

SEG reserves the right to exclude any participant or their parents at their sole discretion.

Health

If a participant has any health issues they must notify SEG at the time of registration for any coaching clinic or attendance of any coaching session. Please include all details of any such problems, including allergies, medication etc.

Insurance

Public Liability insurance is maintained by SEG. Further details are available on request.

SEG reserves the right to add to or amend these Terms from time to time. Amendments will take effect when posted on this website.
